Our infrastructure is hosted by Infomaniak, a trusted Swiss hosting provider, ensuring your data remains secure within Switzerland's robust privacy framework.

2. Key Definitions & Contract Formation
Your contractual agreement with AIXXII is formed immediately upon registration, making a purchase, or beginning to use our services. By clicking acceptance buttons such as "Get Started", "Upgrade", "Subscribe", or similar call-to-action elements, you enter into a binding agreement. These Terms of Service incorporate all linked policies including our Privacy Policy, Cookie Policy, Refund Policy, Affiliate Terms, and AI & Content Guidelines, creating a comprehensive framework for your relationship with AIXXII.
2.1 User
Any individual or legal entity that creates an account, accesses features, or otherwise utilizes AIXXII platform services, whether on a free or paid basis.
2.2 Services
The complete suite of platform features, tools, and functionalities offered through AIXXII, including but not limited to marketplace transactions, learning modules, AI agents, and automation capabilities.
2.3 Subscription/Plan
Your chosen access level to AIXXII services, ranging from Free tier through to Elite premium plans, each with distinct features, capabilities, and pricing structures.
2.4 Processor
A data processor as defined under GDPR and Swiss Federal Act on Data Protection (FADP), handling personal data on behalf of AIXXII in accordance with strict data protection regulations.
3. Account Management & User Eligibility
Creating and maintaining an AIXXII account requires your commitment to accuracy and security. You must provide truthful, current, and complete information during registration and promptly update any changes to ensure our records remain accurate. Your account credentials are your responsibility -- keep your username and password confidential and never share them with unauthorized parties.
We strongly recommend enabling two-factor authentication (2FA) to add an extra layer of security to your account. This simple step significantly reduces the risk of unauthorized access and protects your valuable data and subscription benefits.
Personal users maintain full responsibility for their account activities and must meet minimum age requirements asspecified by local law in their jurisdiction.
For corporate or organizational accounts, the registered company is jointly and severally liable for all account activities, obligations, and payments under these Terms.
All users must maintain the confidentiality of their credentials, enable 2FA when available, and immediately notify AIXXII of any suspected unauthorized access or security breaches.
4. Pricing, Plans & Payment Terms
All AIXXII prices are quoted and charged in Swiss Francs (CHF), which serves as our binding currency for all transactions. While we display prices in EUR and USD for your convenience, these are approximate conversions only and the CHF amount is what you will be charged. Value-added tax (VAT) is applied where legally required based on your location and business status.
Our transparent pricing tiers range from Free access through to Elite premium subscriptions. Each plan offers distinct features, usage limits, and capabilities designed to match different user needs. 4.1 Payment Processing
All transactions are securely processed through Stripe Payments Europe Ltd. for traditional payment methods and CoinPayments Inc. for cryptocurrency transactions, ensuring robust security and compliance.
4.2 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. This ensures uninterrupted access to your chosen plan's features and benefits.
4.3 Late Payments
Overdue amounts accrue default interest at 5% per annum in accordance with Article 104 of the Swiss Code of Obligations, starting from the due date until full payment is received.
4.4 Invoicing
Electronic invoices and payment receipts are provided for all transactions and can be accessed through your account dashboard or will be sent to your registered email address.
4.5
Non-Payment & Termination for Cause
4.5.1
If a payment fails or a subscription fee remains unpaid after the due date, AIXXII may suspend access to paid features until full payment is received.
4.5.2
If the outstanding amount remains unpaid for more than 14 days after written notice, AIXXII may terminate the subscription and close the account for cause.
4.5.3
Repeated payment failures or chargebacks may lead to permanent account suspension.AIXXII is entitled to recover any reasonable collection or legal costs incurred as a result of the non-payment.
4.5.4
Upon termination, any remaining access rights to paid features will immediately cease, without entitlement to refund or credit for unused periods.
5. Trials, Promotions & Refund Policy
AIXXII occasionally offers trial periods, discounts, and promotional campaigns at our sole discretion. These special offers are designed to introduce new users to our platform or reward loyal customers, but they come with important limitations and conditions you should understand.
Trial periods and promotional benefits are limited in duration and scope, as specified in each offer's terms. Any abuse of trials, promotional codes, or discount mechanisms - such as creating multiple accounts to claim repeated benefits - will void your eligibility and may result in account suspension. Promotional benefits are not retroactive and cannot be applied to past purchases or subscription periods unless explicitly stated in the offer terms.
According to Swiss Code of Obligations and EU Directive Article 16(m), there is no withdrawal right once you have begun using digital content or services. Access to platform features constitutes the commencement of use.
Refund requests are evaluated according to our comprehensive Refund & Cancellation Policy, which outlines specific circumstances, timeframes, and procedures for seeking reimbursement.
You may cancel your subscription at any time through your account dashboard or by contacting
billing@aixxii.com. Cancellations take effect at the end of your current billing period, maintaining access until then. No refunds or credits are provided for partial months, unused periods, or downgraded plans.
5.4
Annual & Business Plans
Annual and multi-month subscriptions can be cancelled at any time, but refunds are not provided for unused months. Access remains active until the end of the paid term.
Payments made via cryptocurrency (CoinPayments) are final and non-refundable once confirmed on the blockchain, except in cases of duplicate payment or verified technical error.
Refunds may only be granted if: a double payment or billing error occurred; or AIXXII services were unavailable for more than fourteen (14) consecutive days due to a proven system failure directly caused by AIXXII.All approved refunds are processed to the original payment method within fourteen (14) business days.
AIXXII may suspend or terminate subscriptions for non-payment, misuse, or violation of these Terms. In such cases, no refunds or credits will be issued for remaining periods.

As a member of the AIXXII community, you agree to maintain high standards of conduct and comply with both legal requirements and platform guidelines. Your use of our services must be responsible, ethical, and respectful of other users, our intellectual property, and applicable laws.

Users must not manipulate platform metrics or content visibility through fake engagement, automated actions, keyword stuffing, or any form of deceptive promotion. AIXXII reserves the right to remove such content or restrict accounts engaging in these practices.
7. Intellectual Property & Data Rights
All AIXXII brand elements, user interface designs, platform content, training materials, proprietary prompts, and datasets are owned exclusively by Boppart Digital or our licensors. These assets are protected by copyright, trademark, and other intellectual property laws in Switzerland and internationally.
You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from our platform.Redistribution, commercial reuse, or any exploitation of our intellectual property without explicit written consent isstrictly prohibited and may result in legal action.
You retain full ownership of all content, data, and materials you upload to AIXXII. Your intellectual property remains yours.
You grant AIXXII a non-exclusive, worldwide, royalty-free license to use your content solely for operating and improving our services.
This limited license enables us to process, store, and display your content as necessary to deliver platform features and enhancements.
8.Data Protection & Third-Party Processors
AIXXII is deeply committed to protecting your personal data in full compliance with the EU General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (FADP). Our comprehensive Privacy Policy details how we collect, process, store, and protect your information. We implement robust technical and organizational measures including TLS/SSL transport encryption, strict access controls, detailed logging, and regular geo-redundant backups hosted in Switzerland.

9. Service Availability, Liability & Governing Law
AIXXII strives to maintain platform availability of at least 98% annually, though we cannot guarantee completely uninterrupted service. Scheduled maintenance, emergency updates, and infrastructure improvements may temporarily limit access. Beta features and platform capabilities may change, and we will provide notice of material changes affecting your use.
In the event of security incidents including DDoS attacks, malware, ransomware, or unauthorized intrusion attempts, AIXXII implements appropriate technical and organizational measures per GDPR Article 32 and Swiss FADP requirements. We will isolate affected systems, investigate thoroughly, and inform users as required by law. However, we assume no liability for resulting downtime or consequential losses unless caused by our willful misconduct or gross negligence.

9.1 Indemnification
Users agree to indemnify and hold harmless AIXXII and Boppart Digital, including its officers, employees, and partners, from any claims, damages, or losses arising from unlawful use of the Services, infringement of intellectual property, or violation of these Terms.
9.2 Limitation of Liability & Disclaimers
AIXXII services are provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by applicable law, our aggregate liability is strictly limited to the fees you paid in the preceding 12 months, or CHF 50 total for free-tier users. We accept no liability for indirect, incidental, special, consequential, or punitive damages including lost profits, data, revenue, or reputation.
Force majeure events beyond our reasonable control - including natural disasters, war, terrorism, riots, sanctions, epidemics, pandemics, power failures, network outages, or third-party cloud service disruptions4suspend our obligations until circumstances permit resumption of normal service.
9.3 Governing Law & Jurisdiction
These Terms are governed exclusively by Swiss law, excluding conflict of law rules (IPRG) and the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive venue for any disputes is Zurich, Switzerland, though mandatory consumer protection rights in your jurisdiction remain unaffected. The German version of these Terms prevails in case of any discrepancy with translations.
